This page explains how we handle your personal data when you use this website or get in touch with us, in accordance with Regulation (EU) 2016/679 (GDPR), the Italian Personal Data Protection Code (Legislative Decree 196/2003) and, for people in Brazil, the Brazilian General Data Protection Law (Law No. 13,709/2018, LGPD).
Data controller
The data controller is Luciana Pereira Lima Pulcinelli, based in Maranello (MO), Italy. She is also the encarregada under Article 41 of the LGPD (the Brazilian counterpart of a data protection officer): for any matter concerning your data, write to info@idelma.eu.
What data we collect
- Data you send us: name, email, service of interest, cities and message from the form, as well as anything you write to us by email or WhatsApp.
- Client data: information and documents needed for the service you hire, including access to the client area.
- Browsing data: technical server logs, such as IP address, date and pages visited, used to run the website securely.
Why we use it and on what legal basis
For each use, we give the legal basis under the GDPR and its equivalent under the LGPD.
- Replying to you and preparing a proposal: steps taken at your request before entering into a contract (Art. 6(1)(b) GDPR; Art. 7, V LGPD).
- Providing the service you hire: performance of a contract (Art. 6(1)(b) GDPR; Art. 7, V LGPD).
- Meeting tax and accounting obligations: legal obligation (Art. 6(1)(c) GDPR; Art. 7, II LGPD).
- Sending news by email, only if you ask: consent (Art. 6(1)(a) GDPR; Art. 7, I LGPD), which you can withdraw at any time.
- Keeping the website secure: legitimate interest (Art. 6(1)(f) GDPR; Art. 7, IX LGPD).
Client documents may contain sensitive data, such as health information or family circumstances, needed for visas and school enrollment. We process this data only for the service you requested, with your explicit consent (Art. 9 GDPR; Art. 11 LGPD).
How long we keep it
- Inquiries that don’t lead to a contract: up to 24 months.
- Client data: for the length of the contract and then for 10 years, as Italian law requires for tax records.
- Newsletter: until you unsubscribe.
Who we share it with
Only with those needed for the service to work: hosting and email providers and, where you authorize it for your case, partners we recommend, such as a commercialista (accountant), notary, customs broker or carrier. If you choose to talk to us on WhatsApp, the conversation also passes through Meta’s servers. We don’t sell or rent data.
International transfers
Because we work between Brazil and Italy, your data may travel between the two countries, and some providers may process it elsewhere. In these cases, the transfer follows the safeguards of the GDPR (adequacy decisions or standard contractual clauses) and the LGPD (Art. 33), or is necessary to perform the service you hired.
Your rights
At any time, you can:
- find out whether we process your data, and access it;
- correct incomplete, inaccurate or outdated data;
- ask for the deletion, anonymization or blocking of unnecessary data or data processed unlawfully;
- restrict processing or object to it;
- receive your data in a structured format (portability);
- find out who we share your data with;
- withdraw consent you have given and learn what happens if you don’t give it.
To do so, write to info@idelma.eu. We reply within 15 days. You can also lodge a complaint with the Garante per la protezione dei dati personali, the Italian Data Protection Authority (garanteprivacy.it) or with the ANPD (Agência Nacional de Proteção de Dados), Brazil’s National Data Protection Agency (gov.br/anpd).
Security
We use technical and organizational measures to protect your data, such as restricted access, encrypted connections and passwords in the client area. If an incident could put you at risk, we will notify you and the authorities within the legal deadlines.
